1. Agreement to Terms

By accessing or using Zero Crash ("the App", "Service", "we", "our", or "us"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

These terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Zero Crash is an energy management application that provides:

• Energy level estimates based on biometric and lifestyle data
• Smart scheduling suggestions
• Calendar and wearable device integrations
• Menstrual cycle tracking and correlation with energy patterns
• Burnout risk pattern detection
• Task and productivity management tools

4. User Accounts

To use certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

You must be at least 16 years old to create an account and use our services.

5. Subscription and Payments

Pro Subscription

• Pro subscriptions are billed monthly or annually as selected
• Subscriptions automatically renew unless cancelled
• You may cancel at any time; access continues until the end of the billing period
• Refunds are provided in accordance with applicable law and app store policies

Matcha Bundle (EU Only)

• The Matcha Bundle includes monthly physical product delivery and Pro app access
• Delivery is available only within the European Union
• Products are shipped by our partner suppliers
• You may cancel at any time; the next delivery will be cancelled
• Product allergies and dietary restrictions are your responsibility to verify

Free Trial

We may offer free trial periods. If you do not cancel before the trial ends, you will be charged for the subscription. Trial availability may vary.

6. Third-Party Integrations

Zero Crash integrates with third-party services including:

• Wearable devices (Apple Watch, Garmin, Oura, Whoop, Fitbit, etc.)
• Calendar services (Google Calendar, Apple Calendar, Outlook)
• Health platforms (Apple Health, Google Health Connect)

These integrations are provided "as is". We are not responsible for the accuracy, availability, or functionality of third-party services. Your use of third-party services is governed by their respective terms and privacy policies.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Reverse engineer or attempt to extract source code
• Use automated systems to access the Service without permission
• Share your account with others or create multiple accounts
• Use the Service to collect data about other users

8. Intellectual Property

The Service, including its original content, features, functionality, algorithms, and branding, is owned by Zero Crash and protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any data you provide. By using the Service, you grant us a limited license to use your data to provide and improve our services.

9. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind
• We do not guarantee the accuracy of energy estimates or predictions
• We are not liable for any decisions made based on information from the Service
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid for the Service in the past 12 months

Some jurisdictions do not allow limitation of liability, so some of the above may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Zero Crash and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination:

• Your right to use the Service will immediately cease
• You may request export of your data before termination
• We may delete your data in accordance with our Privacy Policy

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the European Union and the member state where Zero Crash is established, without regard to conflict of law provisions.

For consumers in the EU, you retain any mandatory protections provided by the laws of your country of residence.

14. Dispute Resolution

We encourage you to contact us first to resolve any disputes. For EU consumers, you may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
